Return & Refund Policy

Effective Date: 3 July 2026

This Return & Refund Policy applies to purchases made through www.marlenka.au and is operated by Tatras Trading Pty Ltd trading as Marlenka Australia.

This policy is subject to the Australian Consumer Law (ACL) contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth). Nothing in this policy excludes, restricts or modifies any rights you may have under the ACL.

Change of Mind

Due to the perishable nature of our products, Marlenka Australia does not accept returns or offer refunds or exchanges for change of mind, including where you:

  • ordered the wrong product;
  • ordered more than required;
  • changed your mind after purchase;
  • no longer require the products;
  • entered an incorrect delivery address; or
  • failed to collect or properly store your order after delivery.

Please choose carefully before completing your purchase.

Food Safety

For food safety reasons, we cannot accept returned food products unless they are faulty, unsafe, damaged in transit, or supplied incorrectly.

Products that have left our control cannot be resold or redistributed.

Consumer Guarantees

You are entitled to a remedy under the Australian Consumer Law if a product:

  • is damaged during delivery;
  • is faulty or defective;
  • is not of acceptable quality;
  • is unsafe;
  • is significantly different from its description or images; or
  • is not the product you ordered.

Where required by law, we will provide an appropriate remedy, which may include:

  • a replacement;
  • a refund; or
  • another remedy required under the Australian Consumer Law.

The remedy offered will depend on the circumstances and the nature of the issue.

Reporting a Problem

If there is an issue with your order, please notify us within 48 hours of delivery by emailing info@marlenka.au.

Please include:

  • your order number;
  • your full name;
  • a description of the issue; and
  • clear photographs of:
    • the affected product;
    • the packaging;
    • the outer shipping carton; and
    • the courier label (where applicable).

Failure to provide sufficient information may delay the assessment of your claim.

Delivery

Customers are responsible for ensuring that the delivery address is accurate and that someone is available to receive the parcel where appropriate.

Where you authorise a parcel to be left unattended (Authority to Leave), or the courier leaves the parcel in accordance with your delivery instructions or the courier’s terms, responsibility for the parcel passes to you upon delivery.

Marlenka Australia is not responsible for deterioration of products resulting from:

  • exposure to heat after delivery;
  • delayed collection;
  • incorrect storage by the customer; or
  • an incorrect delivery address provided by the customer.

Additional freight charges may apply if an order must be re-shipped due to incorrect address details supplied by the customer.

Returns

As our products are perishable food items, returns are generally not accepted.

If we determine that a return is required to assess a claim, we will provide instructions before any product is returned. Products must not be returned without prior authorisation.

Refund Processing

Where a refund is approved, it will be processed to the original payment method used for the purchase within a reasonable time after approval.

Shipping charges are non-refundable unless required by the Australian Consumer Law.
